David W. Gibbons is a litigator who acts for clients in a wide range of business and civil disputes. His experience includes corporate and commercial matters, professional negligence, defamation, fiduciary disputes, estate litigation, commercial lease litigation and securities litigation.

David has appeared before all levels of court in British Columbia, as well as courts in other provinces and various administrative tribunals. He has also represented clients in proceedings before the Supreme Court of Canada and both domestic and international arbitral proceedings. Additionally, David has extensive alternative dispute resolution experience including mediations, settlement conferences and other resolution mechanisms.

Before joining his partners at Bojm, Funt & Gibbons LLP, David worked for a number of years at the Vancouver offices of Blake, Cassels & Graydon LLP and then at Lawson Lundell LLP.

David is a director of the Justice Education Society, a British Columbia organization mandated to improving access to justice both domestically and internationally. He is also currently a member of the CBA-BC’s Court Services Committee, a co-author of the Provincial Court Small Claims Handbook and a researcher for the British Columbia Annual Practice (the “White Book”).

Experience

Over the years David has acted as counsel in a broad range of civil actions and other proceedings.

Business Matters:

  • Prior cases include breach of contract disputes, shareholder disagreements, breach of fiduciary duty claims, and many others. He also conducts plans of arrangement before the British Columbia Supreme Court for publicly traded companies.
  • David also represents clients in matters before the B.C. Securities Commission.


Estate Litigation:

  • His clients include both estate beneficiaries and trustees. Topics addressed in proceedings that he has been counsel on include testator capacity issues, challenges to the validity of a will, claims to vary the distribution of a person’s estate and others.

 

Professional Negligence and Disciplinary Matters:

  • David has been counsel for both plaintiffs and defendants in cases involving allegations of breaches of professional duties, including those owed by lawyers, realtors, notaries, mortgage brokers and others.
  • He is also on the list of lawyers with the Law Society of British Columbia who have expressed an interest in assisting or representing lawyers who are subject to the Law Society’s investigation and disciplinary processes and has been engaged opposite Law Society counsel in that capacity.

 

Commercial Lease Litigation:

  • His clients include both landlords and tenants, and his experience includes the non-payment of rent, termination, abandonment of premises, working with bailiffs, and others.

 

Pro Bono:

  • In addition to his board work with the Justice Education Society and volunteer work with the Canadian Bar Association’s Court Services Committee, David represents select clients on a pro bono basis and also regularly volunteers his time with Access Pro Bono’s summary advice program.

 
David also advises and represents clients on a variety of civil litigation matters not captured above.
